Jack Daniels Claims Trademark Infringement Against Bad Spaniels

Many of you may have seen alcohol brand inspired dog toys, such as “White Paw”, “Barkardi” and “Bad Spaniel”. While, I find such dog toys humorous, Jack Daniels does not, and we will soon find out whether the U.S. Supreme Court Agrees. The U.S. Supreme Court  will decide whether parody dog toy, “Bad Spaniels”, is entitled to protection from trademark infringement and dilution-by-tarnishment claims by Jack Daniel’s.

Jack Daniels is arguing as a result of granting trademark protection to Bad Spaniels, Jack Daniels is negatively impacted in its ability to protect its brand. They also argue that such protection enables mass confusion in the marketplace. I do not necessarily agree with Jack Daniels. As a consumer, it is obvious that Bad Spaniel is a parody dog toy and not associated with Jack Daniels. However, if Bad Spaniel was the name of another alcohol brand, then I could appreciate their argument. Interesting to see how the U.S. Supreme Court rules on this.

    This is so funny! Also, i do not see how this enables confusion (subjectively) but i can understand why they may be suing.
