Although IP in the medical / drug setting is nothing new, I found it interesting that part of the IP bought by Revive Therapeutics was data related to getting FDA approval for the use of psilocybin. This reminded me of the issue raised in Geophysical Service Incorporated v Encana Corporation on whether data is an artistic and literary work. When I think of IP, data is not the first thing that comes to mind, but it obviously can be incredibly valuable to companies. Especially if it prevents competing companies from getting that data as well.
